Deferred Prosecution

title-inside title-centered

Deferred prosecution is an innovative diversion mechanism which typically targets first-time, low-risk, or non-violent offenders and offers individuals an opportunity to stay out of jail, access support and resources, and build a life worth living. Although probation and other diversion programs allow individuals to remain in the community while they serve out their sentence, only deferred prosecution programs provide individuals with the opportunity to avoid accruing criminal charges on their record or to have the original charges dismissed after they successfully complete the program.

If you are considering implementing a deferred prosecution program in your office, click here to access a comprehensive implementation guide, developed with prosecutors and defendants in six deferred prosecution programs across three jurisdictions.

Currently, we are working to expand the use of deferred prosecution across the US and to identify the key program components to maximize participants' success.
